NOTICE OF SPECIAL ELECTION
Plattekill Fire District
in the town of Newburgh and town of Plattekill, New York
NOTICE IS HEREBY GIVEN that pursuant to a resolution of the Board of Fire Commissioners, a special election of the qualified voters of the Plattekill Fire District, New York, Town of Newburgh Orange County and County of Ulster, will be held at the Plattekill Fire District’s Fire Firehouse located at 50 Firehouse Rd Wallkill , NY 12589 on the 27th day of January, 2026, between the hours of 6 p.m. and 9 pm. to vote on whether to approve the following resolution adopted by such Board of Fire Commissioners:
RESOLUTION AUTHORIZING THE SALE OF SURPLUS FIRE TRUCK
RESOLUTION OF THE BOARD OF FIRE COMMISSIONERS OF THE PLATTEKILL FIRE DISTRICT, IN THE TOWN OF PLATTEKILL, ULSTER COUNTY, NEW YORK (THE “DISTRICT”), AUTHORIZING THE SALE OF A TANKER WHICH HAS BEEN DECLARED AS SURPLUS APPARATUS WITH A VALUE OVER $100,000.
The resolution authorizing this sale of surplus apparatus was adopted by the Board of Fire Commissioners on June 24th , 2025. All persons registered to vote in the district and residing in the District for at least thirty (30) days prior to the day of the vote may vote in such special election.
RESOLUTION AUTHORIZING THE SALE OF SURPLUS FIRE TRUCK
WHEREAS, the Board of Fire Commissioners of the Plattekill Fire District in the town of Plattekill, Ulster County, New York (the “District”) desires to dispose of one surplus vehicle;
WHEREAS, the Board of Fire Commissioners has evaluated the existing Tanker currently owned by the District and has determined that the Tanker will no longer be needed by the District for any of the District’s purposes;
WHEREAS, the Tanker has a fair value approximately $300,000.00; and
WHEREAS, the sale of surplus fire apparatus with a fair value of more than $100,000 requires that the resolution be authorized in a proposition which is duly submitted and approved at a special fire district election.
NOW, THEREFORE, THE BOARD OF FIRE COMMISSIONERS OF THE PLATTEKILL FIRE DISTRICT IN THE TOWN OF PLATTEKILL, ULSTER COUNTY, NEW YORK (THE “DISTRICT”) HEREBY RESOLVES (by the favorable vote of not less than three-fifths of all its members), AS FOLLOWS:
SECTION 1. The Tanker currently owned by the District has a fair value in excess of $100,000.00 and is hereby declared surplus;
SECTION 2. This resolution shall be subject to a mandatory referendum, to be held at a special election, held on the 27th day January, 2026, at the Plattekill Fire District Fire Station located at 50 Old Firehouse Road, Plattekill, New York 12568, from 6 p.m. to 9 p.m. and the District officers, including the chairperson, are hereby authorized to take such actions to conduct such special election.
SECTION 3. The polls will be open for the purpose of voting during the aforesaid hours, and the ballot will be in substantially the following form, to wit:

duly adopted by the Board of Fire Commissioner of said Fire District on the 24th day of June, 2025 be approved?
SECTION 4. Pursuant to Town Law Section 176(3) this resolution shall be subject to a mandatory referendum, to be held at a special election on the 27th day of January, 2026, in the manner prescribed by Sections 175 and 179 of the Town law of the State of New York. This resolution shall not take effect until approved by the affirmative vote of a majority of the duly qualified voters of the District voting on such proposition. As soon as reasonably possible after the date that this resolution takes effect, the Secretary of the District is hereby authorized and directed to cause a copy of this resolution to be published in full in the official newspaper of the District for such purposes, and to be delivered to the Town Clerk for the town of Plattekill for posting on the sign boards and websites if any, of both town, together with a notice of the Clerk of the District in proper form.
Those who are qualified to vote on the aforesaid proposition are qualified voters who shall have resided in said Fire District for thirty days next preceding such election.
